Anti-spam policy

I. GENERAL

Anti-spam Policy is part of general terms of 1KA use, with which you must agree if you agree to anti-spam policy.

When using 1KA.si services it is not permitted to spread the content that fall within the broad definition of spam, i.e. unsolicited electronic communications or junk. In practice, this means that the use of e-mail addresses without the consent of the addressee for the purpose of the survey is not allowed. Users can send invites for participation in survey only to addressees who had previously in some valid manner agreed with this or is evident within context that there is a certain internal evaluation of users, whose e-mail addresses were collected in a related administrative process of organization, in which you have all the necessary powers and authority for disposal of email addresses.

This takes into account the Personal Data Protection Act (PDPA-1), where email address linked to a person, deemed to be personal data and where the processing of personal data (eg. collection, recording, editing, etc.) is permitted only if the processing is regulated by law or if personal consent of the individual is given.

The user must therefore ensure that while using the 1KA system he will not abuse privacy or otherwise adversely affect the addressee, for example send spam content or for other illegal purposes. In addition, the 1KA e-mail messages may not be used for purposes of direct marketing or sales.

II. SPOOFING

When sending e-mail messages via 1KA.si service, user must always use a valid and functioning e-mail address that represents the sender. Moreover, from this address must be visible, that this is the same person or organization to who addressed previously gave permission to receive invitations to participate in the survey. It is forbidden any kind of counterfeiting ("spoofing") of e-mail addresses where the user is trying to show that the message was sent from a third e-mail address that 1) is non-existent, or 2) user has no permission to send messages on behalf of this third e-mail address, which means that it is an unauthorized malicious presentation with a foreign identity.

III. SPAM CONTENT

The user must ensure that e-mail messages sent via 1KA service do not have such content that would cause that competent operators would classify as spam higher share of sent messages, as is typical for this Internet activity. If the managers of 1KA.si services detect that the user when sending e-mail messages triggered several spam alerts as typically expected, we reserve the right to disable the user the ability to send e-mail messages. In addition, messages sent may not include content that is in any way contrary to the provisions of terms of use of 1KA.si service.

IV. OPT-OUT

E-mail messages sent via 1KA.si service contain a link that allows the addressee refusing to use his e-mail address for the purposes of further sending of electronic messages inviting him to participate in this survey. User guarantees that he will not seek to remove, hide or otherwise disable the visibility and functioning of the connection that enable the addressees of such refusal.

V. FINAL PROVISIONS

When using 1KA service to send e-mail messages, the user commits that with his operation will not in any way adversely affect the information system that supports this service, for example by overload or damage.

In case of violation of the anti-spam policy, which is a prerequisite for using the 1KA service, 1KA may limit or remove corresponding survey.

Further clarification on regulation of email communications by applicable laws and ethical codes can be seen in FAQ: Can I send an email with an invitation to my survey to anyone?
